  • "Account" refers to a registered Probate Logix account associated with a User's email address.
  • "Assessment Report" refers to the probate assessment report generated based on information you provide through our questionnaire.

NO ATTORNEY-CLIENT RELATIONSHIP IS CREATED THROUGH THE USE OF PROBATE LOGIX. ANY AND ALL COMMUNICATIONS BETWEEN YOU AND PROBATE LOGIX ARE PROTECTED BY OUR PRIVACY POLICY BUT NOT BY ATTORNEY-CLIENT PRIVILEGE.

The information provided in our Assessment Reports is for educational and informational purposes only and should not be construed as legal advice. You understand that your purchase, access, and/or use of our Services is neither legal advice nor the practice of law. Our Services are not substitutes for the advice of a licensed attorney.

  • Assessment of appropriateness for your specific situation
  • Tax implications or consequences
  • Review of any existing estate planning documents you may have

6. User Responsibilities

You retain ownership of the information and content you provide to create your Assessment Report ("User Content"). By submitting User Content, you grant Probate Logix a limited license to use, process, and store this information solely for the purpose of providing the Services to you.

You agree not to submit content that: (i) is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable; (ii) infringes on any third party's intellectual property or privacy rights; (iii) contains viruses or malicious code; or (iv) violates any applicable laws or regulations.

8. Payment and Refunds

Payment is required before receiving your probate Assessment Report. All fees are clearly displayed before purchase. We offer a satisfaction guarantee. If you are not satisfied with your report, please contact our support team within 10 days of purchase for a full refund.

9. Intellectual Property

All content, features, and functionality of Probate Logix, including but not limited to text, graphics, logos, software, and the underlying technology used to generate Assessment Reports, are the exclusive property of Probate Logix and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our materials without express written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROBATE LOGIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use of or inability to use the Services
  • Any errors, inaccuracies, or omissions in the content provided
  • Any unauthorized access to or use of our servers or your personal information
  • Any decisions made or actions taken based on information provided by our Services
  • Any legal proceedings or outcomes related to your use of our Services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SERVICES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Probate Logix and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Services; (ii) your violation of these Terms; (iii) your violation of any rights of another party; or (iv) any claim that your User Content caused damage to a third party.

12. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: YOU AND PROBATE LOGIX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Jury Trial Waiver: YOU AND PROBATE LOGIX HEREBY WAIVE ANY RIGHT TO A JURY TRIAL.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms.

13. Governing Law

These Terms of Service and any disputes arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify users by posting a notice on our website and updating the "Last Updated" date at the top of these Terms.

By continuing to access or use the Services after we have posted modified Terms, you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to stop using the Services.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Probate Logix regarding your use of the Services and supersede all prior agreements and understandings.
